STATUTE
§1 DEFINITIONS
Expressions written in this Regulations with a capital letter will have the following meanings, unless the content indicates otherwise:

Store – an online store located at the domain solage-store.com;

Seller – Maja Słowikowska conducting business under the name Solage - Maja Słowikowska, NIP 9542842042, REGON 522382517;

Product, Products – all products offered by the Seller for sale in the Store;

Customer, User – a person using the Store, a Store user;

Regulations – these regulations, which constitute a set of rules for using the Store and making purchases of Products;

Agreement – a sales agreement concluded by and between the Customer and the Seller through the Store. The principles arising from the Regulations apply to the aforementioned sales agreement.
§2 GENERAL INFORMATION
The condition for starting to use the Store is to read and accept these Regulations. By placing an order, the Customer agrees to use the Store in accordance with the provisions of these Regulations, in the wording valid on the day of placing the order. Failure to accept the provisions of these Regulations prevents the use of the Store and the purchase of Products offered by the Seller. The Customer's personal data is processed by the Seller in accordance with the Privacy Policy. All Products offered for sale are new, unused, and produced in Poland. Making purchases in the Store requires the Customer to have an active and functional email account.
§3 GENERAL PROVISIONS
The Agreement is concluded in accordance with the generally applicable laws and these Regulations. Through the Online Store, the Seller sells products within the territory of the Republic of Poland and abroad. The Seller is obliged to provide services and deliver Products in accordance with the Agreement. Contents indicated or provided to the Customer by the Seller within or in connection with the use of the Online Store, including email messages concerning the proposed Agreement, are considered – unless expressly stated otherwise – not as an offer but as an invitation to conclude an agreement within the meaning of the provisions of the Civil Code. All final Prices displayed by the Seller are gross final prices (including VAT). The Prices of Products do not include the cost of Delivery. The Seller displays the Product or service Price in a clear and unambiguous manner. In each case of informing about the reduction of the Product or service Price next to the information about the reduced Price (e.g., reduced due to temporary promotions) in the Online Store, the Seller displays the lowest last price of the Product available at www.solage-store.com within the last 30 days before the price reduction was applied. The Seller is responsible to the Consumer for the conformity of the Product with the Agreement on the terms resulting from Consumer Law, while in relation to Entrepreneurs for the defects of the Product on the terms resulting from the Civil Code and other relevant legal provisions, as well as based on these Regulations. The Seller ensures the Customer using the System the correct operation of the Online Store in the following browsers: FireFox version 65 or newer, Opera version 19 or newer, Chrome version 32 or newer, Edge version 18 or newer, IE version 11, Safari version 14 or newer. The use of third-party software affecting the operation and functionality of browsers: Internet Explorer, FireFox, Opera, Chrome, Safari may affect the correct display of the Online Store.
§4 CONCLUSION AND PERFORMANCE OF THE AGREEMENT
Orders can be placed 24 hours a day, every day, subject to periods related to work aimed at ensuring the Customer's proper access to the functionality of the Online Store or the occurrence of obstacles beyond the Seller's control. To place an order, the Customer should perform at least the following activities, some of which may be repeated: adding the Product to the Cart; choosing the type of Delivery; choosing the type of Payment; choosing the place of delivery of the Goods; placing an order in the Online Store by using the "Buy and pay" button. The execution of the Customer's paid order by bank transfer or through electronic payment systems takes place after crediting the Customer's payment to the Seller's account. The conclusion of the Agreement with the Customer occurs when the Seller accepts the Order, of which the Customer is informed within 48 hours from the submission of the Order. The dispatch of the Subject of the Agreement takes place within 14 working days from the date of crediting the payment. The purchased Subject of the Agreement is sent along with the Proof of Purchase by the type of Delivery chosen by the Customer to the place of delivery of the Goods indicated by the Customer in the Order. The Seller performs actions aimed at ensuring the availability of products presented in the Online Store as available for sale. In exceptional cases, especially in the case of simultaneous placement of an Order for the same Goods by many Customers, it may happen that a given Good is not actually available. In such a case, due to the impossibility of performance, the Customer will be informed about the impossibility of fulfilling the Order (based on the provisions of the relevant Civil Code, including articles 493-495 of the Civil Code).
§5 PAYMENTS
The Seller enables Customers to make payments within the Online Store, especially payments for Products, using methods including: electronic payment carried out in the PayU.com payment system or by transfer to the seller's account. Depending on the circumstances or current business or legal conditions, including depending on agreements concluded by the Seller with third parties, the type of transaction, or the Customer's choice, payment methods, their providers, or other entities participating or mediating in them may change. In case of canceling part or all of the Order, the refund to the Customer is made immediately, but no later than within 14 days from the day of cancellation – in full or the appropriate part of the Price, respectively. The refund is made using the payment method used by the Customer – unless the Customer explicitly agrees to a different method of refund (including a refund to a different bank account).
§6 DELIVERIES
The delivery of Orders covers the territory of the Republic of Poland and selected foreign countries. The delivery of Orders takes place on the terms and conditions, including pricing, specified in the delivery tab.
§7 RIGHT OF WITHDRAWAL FROM THE AGREEMENT STATUTORY RIGHT OF WITHDRAWAL FROM THE AGREEMENT
The Customer may withdraw from the Agreement within 14 (fourteen) calendar days (counting from the next day after the delivery of the order), subject to paragraph 2 below, without giving any reason. The above Right of withdrawal from the Agreement concluded does not apply to the Customer in relation to Agreements in which the subject of the performance is a product made to the Customer's specifications or serving to satisfy his individualized needs. The return of Products can be made by courier or by Polish Post on the Customer's cost to the address: Solage - Maja Słowikowska ul.Szopienicka 44/8, 40-431 Katowice (correspondence address only). The Seller refunds the Customer the equivalent of the Product price and the cost of delivering the parcel to the Customer up to the amount of the cheapest shipment in the Seller's offer. The Seller does not refund the cost of returning the Product to the Seller. In the case of orders sent outside the European Union, the Seller does not refund the cost of sending the parcel to the Customer and the cost of returning the parcel to the Seller. The reimbursement referred to in paragraph 3 above is made by the Seller immediately, and in any case not later than 14 (fourteen) calendar days from the date of receipt of the Product. The reimbursement is made using the same payment methods that were used by the Customer in the original transaction, unless the Customer has explicitly agreed to a different solution that does not involve any costs for him. If the Customer exercises the right of withdrawal from the Agreement after he has explicitly requested that the provision of services be commenced during the withdrawal period, the Customer shall pay the Seller the amount proportional to the part of the service provided until the Customer has informed the Seller about the exercise of the right of withdrawal from the Agreement.
§8 COMPLAINTS
The Seller is obliged to provide the Customer with goods without defects. Detailed information on the Seller's liability for defects in the goods and the Customer's rights resulting from it can be found in the warranty provided by the Seller and the relevant provisions of generally applicable laws. If the purchased Product turns out to be defective, the Customer may file a complaint. The Customer may file a complaint to the Seller in writing at the address of the Seller's registered office or electronically to the Seller's e-mail address or by using the form available on the Store's website. It is recommended that the complaint include, among others, the type and date of occurrence of the defect, circumstances justifying the complaint, data of the complaining party (including contact details), and the Customer's request. The Seller will respond to the complaint immediately, no later than within 14 days from the date of its submission. If the Product has a defect, the Customer may: submit a statement on the price reduction or withdrawal from the Agreement unless the Seller immediately and without undue inconvenience to the Customer replaces the defective Product with a defect-free one or removes the defect. This limitation does not apply if the Product has already been replaced or repaired by the Seller or the Seller has not satisfied the obligation to replace the Product with a defect-free one or remove the defect. request the replacement of the Product with a defect-free one or removal of the defect. The Seller is obliged to replace the defective Product with a defect-free one or remove the defect within a reasonable time without undue inconvenience to the Customer. The Seller may refuse to satisfy the Customer's request if it is impossible to bring the defective Product into conformity with the Agreement in a manner chosen by the Customer or if it would require excessive costs compared to the method proposed by the Seller. If the Product has a defect, the Customer may also demand replacement of the defective Product with a defect-free one or removal of the defect. The Seller is obliged to replace the defective Product with a defect-free one or remove the defect within a reasonable time without undue inconvenience to the Customer. The Customer may not withdraw from the Agreement if the defect is irrelevant.
§9 PROVISION OF ELECTRONIC SERVICES
The Seller may provide the Customer with services electronically. The Customer may agree to the provision of services electronically by the Seller by activating the appropriate option in the Customer's account. The provision of electronic services by the Seller may be terminated at any time by the Customer, and by the Seller in case of violation by the Customer of generally applicable laws or the provisions of these Regulations. The Seller is obliged to provide services electronically free from defects. The Seller is responsible to the Customer who is a Consumer for defects in the provision of electronic services on the terms specified in generally applicable laws.
§10 PERSONAL DATA AND PRIVACY POLICY
The administrator of personal data provided by the Customer is the Seller. The Seller processes the Customer's personal data for the purpose and to the extent necessary to perform the Agreement concluded with the Customer, as well as for marketing purposes, provided that the Customer agrees. Detailed information on the processing of personal data by the Seller, as well as the rights of the Customer in this regard, can be found in the Privacy Policy available on the Store's website.
§11 FINAL PROVISIONS
These Regulations are valid from [insert date]. The Seller reserves the right to amend these Regulations for important reasons, in particular, changes to the law, changes in the methods of payment and delivery – to the extent to which these changes affect the implementation of the provisions of these Regulations. Amendments to the Regulations come into force on the date indicated by the Seller, which may not be shorter than 14 days from the date of publication of the amended Regulations on the Store's website. Orders accepted by the Seller before the date of entry into force of the amended Regulations are implemented on the basis of the Regulations valid on the date of placing the Order by the Customer. In matters not covered by these Regulations, the relevant provisions of generally applicable law shall apply.
